Pennsylvania House Passes Recreational Cannabis Bill, Faces Uncertain Future in Senate

On May 7, 2025, the Pennsylvania House of Representatives narrowly approved House Bill 1200, a measure to legalize recreational cannabis for adults aged 21 and over. The vote, split 102–101 along party lines with all Democrats in favor and all Republicans opposed, marks the first time such legislation has passed either chamber in the state.

Key Provisions of HB 1200

  • State-Run Sales Model: The bill proposes a unique approach by having the Pennsylvania Liquor Control Board oversee cannabis sales through state-run dispensaries, separate from existing liquor stores.
  • Home Cultivation: Residents would be permitted to grow up to two mature and two immature cannabis plants at home with a cultivation permit.
  • Revenue Allocation: Projected to generate over $500 million in the first year, the revenue would fund Medicaid, public transit, education, minority business development, substance abuse programs, and expungement of marijuana-related convictions.
  • DUI Reform: The bill includes provisions to prevent drivers from being charged with DUI solely based on the presence of cannabis in their system if they are not impaired.

Opposition and Senate Outlook

Despite passing the House, HB 1200 faces significant hurdles in the Republican-controlled Senate. Senator Dan Laughlin, a leading Republican voice on cannabis policy, stated there is “no path forward in the Senate for a state store model for adult-use cannabis.”

Critics argue that the state-run model could stifle small business participation and disrupt existing medical cannabis operations. Some lawmakers advocate for a privatized system, suggesting that such an approach might garner broader support.

Governor Josh Shapiro has expressed support for legalization, highlighting the potential fiscal benefits to address the state’s budget deficit.
